Yesterday, a federal judge in Little Rock, Arkansas granted class-action status to truck drivers accusing Wal-Mart Stores Inc. (NYSE: WMT) of using racially discriminatory practices in hiring drivers, according to the Arkansas Democrat-Gazette.
The suit will include all black applicants in the U.S. who were denied driving jobs since September 22, 2001, and those who say they were denied or prevented from applying for a driving job as a result of Wal-Mart's policies.
U.S. District Judge William R. Wilson Jr. said that Wal-Mart drivers were screened by a committee of drivers. The judge noted that none of the screening committees had a majority of African Americans while some committees lacked any, despite a company rule that the panels be 50% diverse.
The class-action suit is expected to include less than 10,000 people. Plaintiffs looking for punitive damages would need to separately file a suit after the class-action case, according to the ruling.
It seems that discrimination continues to affect the working man. This case reminds me of the recent FedEx Corp. (NYSE: FDX) racial discrimination settlement (as well as the one in 2005). The suit alleged that FedEx Express discriminated against African American and Hispanic workers by paying them less than Caucasian workers, passing them over for promotion and treating them unfairly in evaluation and disciplinary proceedings.
While FedEx had denied committing any acts of racial discrimination, there was a $53.5 million payout to make the case go away. On the day of the settlement, FedEx shares were barely hurt, down 57 cents that morning. I expect Wal-Mart to look for a settlement and its shares to experience the same treatment as FedEx's on the news.

Have you been to a Wal-Mart store lately? All across the country from Virginia to California, from Texas to Florida, Wal-Mart more than meets its
racial requirements in its stores. Most of their store and warehouse personnel are racially met. Most of the personnel in their stores are black and/or hispanic. Actually mostly black. I've researched this so I know. Thank You.

I work for Wal-Mart and as a matter of fact my job is to unload trucks so I get to see almost 100% of the drivers that come in our store. I can honestly say without bias that it is around 50/50 wht/blk. Not to sound hasty but you have to relize what part of the country, state, and city you are applying for a job. My store is like 40%wht and 60blk but there is a store less than 20 miles south of me that is 99%blk. only 5 white associates in the store. We have to keep a open mind and let the courts sort it all out. Wal-Mart is not out to get everyone but It does hurt my family when things like this happens.

In our Wal-Mart, in Missouri, there are hardly any assosiates that are of any color. My son, who is half African American,Irish and Indian, was being followed around the store by a store manager! My son was walking up to me and he whispered to me "Mom this guy has been following me around the store since we came in". I noticed him to be a store employee with a jacket zipped up, covering his name tag! He zipped it up higher when I faced him on the matter. I told him I knew him to be an employee and unless he wanted to end up explaining his actions to a courtroom he best stop following my son. I said it loudly in front of alot of customers so he was totally embaressed and beet red! I know they are racially weak expecially in racially bias towns! They are just reflecting their communities in that department, but as for the truck drivers that is another story. They travel, but what about the screening commitees? Where are they from? Do they travel or are they from the same towns they work at? And by the way the only people who get what they want in a class-action case are the lawyers. They always settle out of court and never can stand up to the big lawyers such as Wal-Mart will no doubt have. I hope the people that are sueing have some really good lawyers and go to court. I have been in a class-action suit. The pharmacist that diluted the chemo, gave it to my father. I was shocked when they only tried one case, and made the rest of us sign a blank "settlement" or settle for nothing! Our lawyers couldnt stand up to the New York lawyers of the pharmasutical companies. I really hope this goes to court, otherwize it will get swept under the rug in favor for walmart, not the drivers. They'll get a few dollars and still not feel their rights were protected or honored.

walmart is a good company to work for but it is bad when the store manager want speak to to you after you have said good morning to them unless you are white. everyone she talks to is white.i went though receiving one morning and said good morning to the store manager and she was talking to a white associate she did not speake she just kept on talking to the white associate. it sure did hurt my feeling but now i dont speak to her . this is a bad problem

As an former Wal-Mart associate i can't belive that they are guilty of these charges, It sounds to me that because of the size of the company they are just trying to get some money, hopeing that they will settle out of court to avoid the rumors, Wal-Mart has always been fair and just in their hiring practices and with their complants from the associates, they have an great system to report you're complants to management

i was fired as a truck drive when i had to stop my truck short of dock to pull out a loading ramp. lady from bendville ark boss told me to back all the way back .so i did . now my truck was to high to unload she told me i didn t know how to drive and i was fired so i got back in my trock pulled it up she said stop that good . isaid so idont work for you and drove off truk and all

Angie - although you may see Minority Truck drivers where you make your deliveries the issue may depend on the State in question. We are living in a country where there are still Golf courses that are "exclusive" meaning Whites only. Do you really think a panel of all white truckers in the south would hire a minority? Twenty Five years ago I was for evening the so called playing field and giving everyone a fair chance but the total decline of every facet of American life over that time has made me realise that when you just throw every thing into the melting pot you don't always get a good stew, mostly all you get is a pile of shit.

I've been in Wall-Mart lots of times. On one of my most recent visits, I was shocked when I heard the the music/advertising on the stores P.A. system was 100% in Spanish, and we're over 50 mi. from Mexico. I worked for a Local CATERPILLAR dealer here for 9 yrs. and was shocked when I read a memmo that was Instructing managers to give preference to Homosexuals and minorites in hiring. They were the ones to pay the most attention to, and to hire them over anyone else. Even thou other applicants were more skilled and experienced than their "Prefered Group". Not too obvious ya think? I don't know about you but I can't recall ever hearing of any Homosexual Heavy Equipment Mechanics. I don't know how to straighten all this out. I honestly haven't heard of even one course of action, at least none that wouldn't have us end up in jail.... With my luck, I have to share a cell with someone named "BRUCEY or BUBBA" That's not giving me a very good picture in my mind, Nope, not good at all. Most all of us need to work, and I've never been one to talk badly of the person, or refuse to work with them. There have been times I would've liked too. But that's only after they displayed a total lack of knowlege of what we were doing, or caused too many close calls.........
We'll get it all worked out one of these days, but then they'll just have a new set of problems to work through.......... JP ..............

I love Walmart. They have great prices and I can buy everything under one roof. As for this lawsuit...just another case of someone wanting something for nothing and without having to work. We are all Americans...different races..Italian, Hispanic, Russian, German, Chinese, etc. Whomever is the most qualified get the job, period...its not about color. This is not a domino set. This is such BS, and it just continues...looking for money without having to work for it....the American way I suppose. Its insulting and such BS.

I haven't shopped in Walmart in years. Understaffed, a 30 minute line wait is a bit long, no matter what time of day it is. I went once at 3 am just to check out quickly- still 35 minute wait because they only had one cashier. There were 16 people in that line. I'd rather spend more of stuffthan be treated that way.

This is really sickening...I know there is still racism in this country (latest is the Imus racist comments); now Wal-Mart is facing a racial discriminatory lawsuit!!! I am a female Black Wal-Mart associate in Ohio and in the 6 months I have been with them, the only comments are from some of the White customers who do not like to be waited on by a Black cashier or from the Black customers who do not like to be waited on by a White cashier. I understand this story only pertains to the truck drivers who believe they were racially discriminated by Wal-Mart. I, for one, love my position (cashier)there and the customers love me back for the exceptional service I give them. Believe me when I say this, but some of these claims are unnecessary unless there was video or written proof of the situation.

This race card has been sucessful for many years. I found myself relocating to Texas in the 80's for a career in law enforcement. I was unable to be hired in New York. The percentage was 5 minorities to one white. I learned that a hipspanic scoring a 50 on the exam was hired after my interview and an 85 score on my exam. It's gotten to the point where the caucasian is now the minority status. We are purely discriminated against. Now even illegal aliens which by law have no rights in this country are given the opportunity to protest U.S. laws and policies while our administration overlooks the millions that are crossing our borders. I stopped at a K-Mart on Long Island during a fishing trip. All the cashiers were of hispanic decent. The translator was the head cashier. If any questions arose at the register he would translate to the customer if they did not speak Spanish. I asked what the reasoning was for this . it was explained to me in broken English that it was a work program. I found a lot of work programs on that island. I only see this getting worse. It has already started with the illegal aliens crossing our borders by the millions as our administration attempts to create a guest workers program to suit the illegals. I don't see Big AL going to any farms that are employing illegals. I don't view the U.S. as a strong country anymore. If you WHINE you get your way. Our administration proves that. History does repeat itself and the U.S. mimics the Roman Empire. THINK ABOUT IT!!
