On November 20th, I wrote about the tragic, and appalling, tale of Deborah Shank -- a Wal-Mart (NYSE: WMT) worker rendered severely brain damaged after a crash with a truck.
Her insurance, provided by Wal-Mart, paid for her medical needs, and Ms. Shank and her husband received $700 thousand in a settlement from the trucking company that crashed into her. Then Wal-Mart, a $190 billion company, sued for the money to recoup the amount it spent on her medical care.
The legality of the move aside, it's appalling on a moral level. WalMartWatch has more information available, and is also collecting donations to aid the family. That site sums it up well:
This holiday season, Wal-Mart rolled out a new slogan: "Save money. Live better."
But who lives better with Wal-Mart's low prices? Clearly, it isn't Wal-Mart employees like Deborah Shank.

We the people....we should stand up and be heard. Demand that all loopholes in all insurance policies be abandoned. Wal-Mart should be ashamed of itself for their treatment of their employees and the cheap crap they now sell. Sam is surely spinning in his grave over this farce.

I am not sticking up for anti-Union Walmart, they suck on any day. But Most people are unaware,that almost all Health Insurance Policy's have a Subrogation Clause,which requires you to pay them back,when you sue and collect any kind of damage/pain suffering award. You dont pay back,if you dont sue, but its the old theory you cannot profit from a misfortune.Since all insurance law is written by attorney's ,who are looking out for the Insurance Company, not the injured party this is what happens to the working man or woman,they get a Legal Screwing.

Walmart should collect from the company who WAS RESPOSIBLE FOR THE injured. They are responsible for the accident. Walmart is trying to collect from the wrong people.

Wal-Mart is the typical psychopath. It puts the bottom line ahead of everything including people. I don't think I would call a cash settlement a windfall considering how that woman will spend the rest of her life... quality of life??? What quality?
Wal-Mart exploits everyone and everything. Made in China proves that. Sweat shop labor to make cheap crap sold at obscene prices considering what it is. The American people should wake up and NEVER shop at Wal-Mart. People have the power, it is time we used our buying power to put psychopathic corporations out of business.

This is a common practice and if you lemmings want to exercise that feigned outrage you've been practicing, use it on the lady (or her estate, as I doubt she has very much to say about anything these days) who sued the trucking company, but refused to use the money she was awarded for its intended purpose, which was for medical bills.
Immoral and appalling behavior, and part of her rehabilitation therapy ought to include some lesson on the phrase "what goes around comes around".

I quit shopping at WalMart long ago. The store near me should be renamed The WalMart Dollar Store. All junk at WalMart, it's true you only get what you pay for. They sell junk and rip off the employees. Would this suit be hapening if it was Costco? No way! Or say Kohls? No way!

Hopefully the economy will turn in such a way that Walmart will become extinct. I go there ONLY because the company I work for gives out walmart gift cards for performance scores. We have a computer that each employee has to log into when they start a task and if your performance is at a certain level over a given period of time you get a $25.00 gift card. Seems more and more companies are turning to computers to monitor employee performance. Guess they can dump the supervisors. Why have them when you can use a computer? Digital Logistics is the name of the new boss.

With the amount of money that walmart takes in annually, her medical expenses are a drop in the ocean by comparison. So this milti million dollar company is suing her for the money that an insurance company paid out? Then why have medical insurance to begin with? ALso given that most employees also pay into this medical benefit, walmart should reduce the amount of money they are seeking by the ratio of what they pay to what she pays. I mean if you are going to be fair then be fair all the way. Walmart is nothing more than a bunch of rich bastards sucking the life out of the poor and making them dependent on the rich bastards. The one good thing is when the rich bastards are rotting in their graves, they are no longer rich, they are however still bastards. Also their bodies decay just as readily as the poor person they are trying to screw, the employee. Thus they look the same after a few years of decay. But then it is their soul that has to put up with the consequences of their actions and I understand that it is the poor slob that get the better treatment as opposed to the rich bastard. Karma is a good thing!

Normally when you accept a settlement for an injury and you get paid for past and future medical treatment, you are meant to pay back whoever initially paid for your treatment and also pay for all future treatment yourself.
I don't really like Walmart as a company but I have to say that they aren't doing anything wrong.
And why should the person collect all this money for future medical care etc and then expect someone else to pay for it and have them keep the money.

walmart and safeway both would do the same thing to save a buck. they can't see losing at all even if they are at fault. safeway and walmart set up workers all the time. the only difference is safeway is union. i feel sorry for this woman and what her family has to deal with. these large corporations couldn't give a rats ass as long as their investors keep filling their pockets.

First of all Wal-Mart is partially self insured.......some states offer both Wal-Mart "self insured" BC/BS, and another plan. Second, windfall settlement?????? I think not. What do you think the cost of Ms. Shanks's healthcare will be for the years to come? Where do you think that money will come from? Oh, um ya us. Medicaid will now be paying her bills to stay in an assisted living center and not in her own home with her own family at her side. Multi-billion dollar company..don't tell me that this is an ethical or respectful thing to do.....almighty dollar. So. you pay insurance premiums to make sure that you are able to afford to live should you become ill. So, what did she pay her insurance for? My sympathy goes to her family and shame goes to Wal-Mart
