Flavored cigarettes off the shelves


As of Tuesday, you'll have to cross a border to buy a clove. The U.S. Food and Drug Administration's ban on flavored cigarettes went into effect and prohibits the sale of candy and fruit-flavored cigarettes. Authorized under the Family Smoking Prevention and Tobacco Control Act, the measure is intended to reduce the number of children who take up the habit.

Under the new ban, cigarettes that include "an artificial or natural flavor (other than menthol) or an herb or spice" cannot be sold in the United States. The long, but not exhaustive list of flavors, consists of strawberry, grape, orange, clove, cinnamon, pineapple, vanilla, coconut, licorice, cocoa, chocolate, cherry and coffee.

A company that continues to "make, ship or sell such products may be subject to FDA enforcement actions," the statement from the FDA continues.

According to Reuters, Dr. Lawrence Deyton, head of the FDA's center for Tobacco Products, said on a conference call with reporters, "Candy and fruit flavored cigarettes are a gateway for many children and young adults to become regular tobacco users."

Menthol cigarettes are specifically excluded from the measure, though the FDA is exploring ways to regulate these products, as well as non-cigarette tobacco products that are flavored. Other flavored tobacco products currently on the market include certain types of pipe tobacco and cigars. Reuters reports that approximately 12 million Americans smoke menthol cigarettes. Congress has told the FDA to study the issue.

The new FDA measure is not expected to affect major U.S. tobacco companies – such as Altria Group's Philip Morris (NYSE: MO) and Lorillard Tobacco Group (NYSE: LO) – which do not manufacture flavored cigarettes.
