Excluding these charges, LLY tallied $1.07 per share in the quarter -- topping analysts' estimates for $1.05 per share. Taking the ImClone acquisition (which cost LLY $4.73 billion in charges) into account, LLY lost $3.31 per share during the quarter. <p>And analysts expect <a href="http://finance.aol.com/quotes/freeport-mcmoran-copper-and-gold-inc/fcx/nys">Freeport-McMoRan Copper &amp; Gold Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/freeport-mcmoran-copper-and-gold-inc/fcx/nys">FCX</a>), <a href="http://finance.aol.com/quotes/tyson-foods-inc/tsn/nys">Tyson Foods Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/tyson-foods-inc/tsn/nys">TSN</a>), <a href="http://finance.aol.com/quotes/e-i-du-pont-de-nemours-and-company/dd/nys">DuPont</a> (NYSE: <a href="http://finance.aol.com/quotes/e-i-du-pont-de-nemours-and-company/dd/nys">DD</a>), and <a href="http://finance.aol.com/quotes/sun-microsystems-inc/java/nas">Sun Microsystems Inc.</a> (NASDAQ: <a href="http://finance.aol.com/quotes/sun-microsystems-inc/java/nas">JAVA</a>) to have swung to losses for the most recent quarter, from profits in the same period a year ago. And <a href="http://finance.aol.com/quotes/ford-motor-company/f/nys">Ford Motor Co.</a> (NYSE: <a href="http://finance.aol.com/quotes/ford-motor-company/f/nys">F</a>) is expect to have deepened its net loss.</p>

The 1.9% GDP report was lighter than the 2.2% estimates, but despite feeling like a recession, it isn't formally a recession. Equities headed south as did oil prices by more than $2.00 per barrel. Investors chose to focus on the bad data today and take profits. The company beat estimates last night but guidance was a few percentage points light and the investment community still demands growth here. If you think this stock won't be rising too far in the coming months, then it could be a good time to look at a bearish hedged play on IMCL.<br /><br />After hitting a one-year low of $30.34 in August, the stock hit a one-year high of $49.18 in April. This morning, IMCL opened at $42.66. So far today the stock has hit a low of $41.94 and a high of $43.49. As of 12:40, IMCL is trading at $42.02, down $2.81 (-6.3%). Citi posted a $52 price target for IMCL and expects to hear good news at an upcoming conference. If you think that the company won't fall by too much in the coming months, then now could be a good time to look at a bullish hedged trade on IMCL.
<p>After hitting a one-year high of $47.94 in October, the stock hit a one-year low of $30.00 last March. IMCL opened this morning at $44.81. So far today the stock has hit a low of $43.61 and a high of $45.20. As of 11:33, IMCL is trading at $43.80, up $0.71 (1.7%). Now, he has issued a trading alert, once again recommending the shares. </p>
<p>Two events, he says, are the basis of his new buy. The editor of <a href="http://www.thestockadvisors.com/ccount/click.php?id=757">The Medical Technology Stock Letter</a> says, "The first event was Amgen's failed clinical trial of their competing product, Vectibix, when used in combination with Avastin and FOLFOX for the treatment of front-line metastatic colorectal cancer."</p>
<p>This, he notes, has "significantly strengthened" the competitive position of Imclone's Erbitux versus Vectibix. The second event, he adds, was the recent failure of Erbitux in the pancreatic cancer setting, which caused the stock to sell off. </p>

DNA is recently down $3.06 to $82.22. <br />DNA is providing investors today with an overview of recent developments. DNA says it "aims to bring at least 20 new molecular entities into clinical development between 2006 and 2008." Bloomberg reported DNA that said Avastin lung cancer study was stopped for safety. DNA call option volume of 12,491 contracts compares to put volume of 11,435 contracts. DNA April option implied volatility of 20 is below its 26-week of 25 according to Track Data, suggesting decreasing price risks. </p>
<p><strong>Abbott Laboratories </strong>(NYSE:<a href="http://finance.aol.com/quotes/abbott-laboratories/abt/nys">ABT</a>) option implied volatility flat as ABT near 5-year high into ACC 2007. ABT is recently at $54.28. <br />ABT has four business segments: Diagnostic Products, Nutritional Products, Pharmaceutical Products &amp; Vascular Products. The American College of Cardiology annual meeting takes place in New Orleans, March 24-27. ABT overall option implied volatility of 18 near its 26-week average according to Track Data, suggesting non-directional risk.</p>

GPS closed Monday up $1.37 to $20.26 after CNBC's David Faber reported Goldman Sachs was hired to explore strategic alternatives. GPS CEO Paul Pressler has been operating GPS for over four years. The Los Angeles Times reported a story on January 6 2007 that quoted analysts as saying they expect GPS to make some type of change. GPS call option volume of 21,511 contracts compares to put volume of 17,152 contracts. GPS February option implied volatility of 35 is above its 26-week average of 30, according to Track Data, suggesting larger price fluctuations. <o:p></o:p></p>

Not too long ago, on October 10th, Carl Icahn, the activist investor, has finally got his wish as Kies, the former ImClone Systems Corp. (NASDAQ: IMCL) chairman, <a href="http://www.bloggingstocks.com/2006/10/10/ask-and-ye-shall-receive-imclone-chairman-resigns/">resigned</a>. Icahn, who owns about 14% of the company, had several issues with a few of ImClone's management and board members as to how the company is run, among them low sales of Erbitux, the cancer drug.</p>
<p>This morning, ImClone <a href="http://money.aol.com/news/articles/_a/imclone-systems-reports-third-quarter/n20061025072209990002">reported</a> third-quarter results that <a href="http://www.marketwatch.com/News/Story/Story.aspx?guid=%7BE20B2D41%2D4F83%2D40DD%2DBE1E%2D8704DA9F6EAF%7D&amp;dist=feed&amp;siteid=aolpf">blew expectations</a>. Not only did net income rise 85.2% to $57.3 million, or 65 cents a share, but revenue rose 41.5% to $150.7 million. Analysts were expecting earnings of 45 cents a share on revenue of $162 million. What's more, sales of Erbitux got a push from a a 63% rise of Bristol-Myers Squibb Erbitux sales. ImClone receives a 39% share of that in way of royalty revenue.</p>
<p>Yet, IMCL stock is up a modest 0.75%. (Update: I guess it took some time until the Street digested the news and decided it approved -- IMCL stock is now up around 2.5%).</p>
<p>Remeber that back in September Icahn filed a proxy statement to remove half of ImClone's board stating "they have done a deplorable job running the company." After these results, I find that somewhat odd. The filing eventually led to Kies and other board members resigning. Among their biggest rows was Icahn derailing a $36 a share buyout offer. Icahn claims he didn't think the offer was serious. Well, he now has an almost free hand to do as he pleases, as most of ImClone's board members are his allies.</p>
<p>One of Icahn's first priorities would be to restore ImClone's relationship with Bristol-Myers Squibb Co. (NYSE:BMY), which not only markets ImClone's product but also holds 17% of ImClone. It has been speculated that Bristol-Myers might eventually buy out ImClone. Icahn's other priority would be to hire a CEO. This case is no different.</p>
<p>For a while now, activist investor Carl Icahn put pressure on ImClone Systems Corp. (NASDAQ: IMCL) board and shareholders, demanding the resignation of chairman David Kies. This morning, Kies has finally resigned, effective immediately. Board member William W. Crouse has also resigned effective immediately. No official reasons were given.</p>
<p>Icahn has a 14% stake in ImClone, a biotech company making the cancer drug Erbitux. The company was for sale during most of the year until August.</p>
<p>Earlier this month, Icahn sent a proposal to shareholders, asking them to remove half, that is, six of the 12-member board. Kies was only one of them, CEO Fischer another. Icahn suggested a person of his choice to be elected for the board. Icahn's reasoning were failure to expand sales of Erbitux and the inability of the board to reach a decision regarding a $36 per share bid from an unknown drugmaker. Update: According to <em>The New York Times,</em> the bidder was France's Sanofi-Aventis SA.</p>
<p>In response to Icahn's proposal, ImClone <a href="http://money.aol.com/news/articles/_a/imclone-systems-board-of-directors-urges/n20061003152709990003">urged</a> investors to reject it, saying he failed to support the bid and that his suggestions "are not in the best interests of the Company's stockholders."</p>

<p>Legendary buyout maestro, Carl Icahn, likes to stir the pot. Hey, it's made him a multi-billionaire.</p>
<p>His latest prey is <a href="http://www.imclone.com">ImClone Systems</a>, a company that has been the source of much turmoil over the years. And, the company's shareholders definitely want some change -- as they have elected Icahn and two of his allies to the board. Currently, Icahn has control of a third of the board. Oh, and he owns about 14% of the outstanding shares.</p>
<p>Icahn also likes to write letters to management -- and these letters are, well, not very uplifting. </p>
<p>In the case of ImClone, Icahn has penned an interesting letter, which was disclosed at the <a href="http://www.sec.gov/Archives/edgar/data/765258/000092847506000214/sch13da091406.txt">SEC site</a>.</p>
<p>The leader starts with "Dear David" (who is the Chairman of the board). Basically, Icahn wants David to leave. He is also disappointed with the hiring of the company's CEO. Yes, he should leave too.</p>
<p>Icahn even calls David's performance a "sorry record." He mentions the apparent "passivity in pushing to start appropriate trials in first-line colon cancer and other indications." Icahn is also worried about "employee dissatisfaction and probable defections." Of course, there was ImClone's loss of a major patent suit during the past week (relating to the Erbitux drug). </p>
<p>No doubt, ImClone needs some discipline to get things moving in the right decision. And, it looks like it will take the tough tactics of a billionaire who likes a good fight.</p>

She's agreed to pay the maximum fine of $195,000 and agreed not to serve as director of a publicly held company for five years. Stewart is of course, the personality and creative force behind her brand, so a title hardly matters. Shares of Martha Stewart Living Omnimedia Inc. (<a href="http://finance.aol.com/usw/quotes/quotesandnews?exch=NYS&amp;from=lookup&amp;sym=E%3ANYS%3AMSO">MSO</a>) rose 12 cents to $17 in morning trading on the NYSE. <br /><br />If I remember correctly, Stewart made about $40,000 off the sale ImClone stock acting with insider information, which has got to make it the hardest $40k she ever earned. I thought jail time (she served five months) too harsh, but, <a href="http://www.bloggingstocks.com/2006/07/05/ken-lays-death-provides-shocking-moral-lesson/">unlike executives who've done far worse</a>, she manned-up and took it, and though the experience could have crushed her, she wouldn't let it, and she's been back now for awhile, probably to stay. <br /><br /><em>Michael Canfield is a private investor, a business and media writer, living in Seattle.
