    <li>FBR Capital upgraded Microsoft (<a class="inlinked" href="http://www.dailyfinance.com/quotes/microsoft-corporation/msft/nas">MSFT</a>) to outperform from market perform, citing valuation and the ongoing corporate PC cycle refresh. The firm upped its target for shares to $32 from $31.</li>
    <li>Oppenheimer upgraded BP (<a href="http://www.dailyfinance.com/quotes/bp-p-l-c/bp/nys" class="inlinked">BP</a>) to outperform from perform with a $55 price target as it sees greater upside potential than downside risk from the oil spill.</li>
    <li>Wunderlich upgraded Stericycle (<a class="inlinked" href="http://www.dailyfinance.com/quotes/stericycle-inc/srcl/nas">SRCL</a>) to hold from sell and raised its target for shares to $50 from $42, citing the company's alliance with Republic Services (<a class="inlinked" href="http://www.dailyfinance.com/quotes/republic-services-inc-cl-a/rsg/nys">RSG</a>).</li>
    <li>Illinois Tool Works (<a class="inlinked" href="http://www.dailyfinance.com/quotes/illinois-tool-works-inc/itw/nys">ITW</a>) was upgraded to overweight from equal weight at Barclays.</li>
    <li>GameStop (<a class="inlinked" href="http://www.dailyfinance.com/quotes/gamestop-corp-new/gme/nys">GME</a>) was upgraded to buy from neutral at Janney Montgomery.</li>
    <li>Fluor (<a class="inlinked" href="http://www.dailyfinance.com/quotes/fluor-corporation/flr/nys">FLR</a>) was upgraded to buy from neutral at Goldman.</li>

The firm raised its target on shares to $105 from $95.</li>
    <li>Janney Montgomery upgraded Shutterfly (<a href="http://finance.aol.com/quotes/shutterfly-inc/sfly/nas">SFLY</a>) to buy from neutral to reflect valuation and a reduced pricing overhang after Kodak (<a href="http://finance.aol.com/quotes/eastman-kodak-company/ek/nys">EK</a>) raised its 4x6 prices. The firm raised its target on shares to $21 from $18.</li>
    <li>Thomas Weisel upgraded Entropic Communications (<a href="http://finance.aol.com/quotes/entropic-communications.../entr/nas">ENTR</a>) to overweight from market weight. The firm thinks the company is well-positioned for revenue growth in 2010, partly due to MoCA deployments from new customers and design wins for its silicon tuner product. The firm set a $5 target.</li>
    <li>T. Rowe Price (<a href="http://finance.aol.com/quotes/price-t-rowe-group-inc/trow/nas">TROW</a>) was upgraded to buy from hold at Jefferies.</li>
    <li>Dick's Sporting Goods (<a href="http://finance.aol.com/quotes/dick-s-sporting-goods-inc/dks/nys">DKS</a>) was upgraded to buy from neutral at BofA/Merrill.</li>

While the results were five cents shy of last year's results, they topped the consensus estimate by a penny per share. Quarterly revenue totaled $446.8 million, far better than the Street's estimate calling for $343.1 million. <br /><br />The company also announced that <a href="http://money.aol.com/rtn/ap/cke-restaurants-june-same-store-sales-fall/rfid226096494?channel=pf">same-store sales dropped</a> 5.2% during the latest four-week period. The top line fell a little over 4%, coming in at $336.6 million. On a diluted basis, the bottom line cooked up $0.10 per share. That was a penny less than what was earned last year, but the company did manage to meet Wall Street's expectations.</p>
<p>Moving away from total sales and net income, let's look at the all-important same-store sales results. For the third quarter, comps for both CKE brands on a blended basis rose 0.9% according to the <a href="http://www.tradingmarkets.com/.site/news/Stock%20News/2077281/">earnings release</a>. An earlier <a href="http://money.aol.com/news/articles/qp/pr/_a/cke-restaurants-inc-reports-positive/rfid166068941">press release</a> focusing on same-store sales in November, had comps increasing by 0.3% on a blended basis. Year-to-date, blended comps moved 1.9% higher. When you compare these changes to their respective year-ago periods, you'll see that CKE isn't really doing gangbuster business. <br /></p>
<p>I find neither the earnings numbers nor the sales figures particularly compelling. Management seems to think that the dreadful economic crisis we're facing is mostly responsible. Hey, it certainly isn't helping, and I sympathize with CKE's challenges during the credit crisis. Yet, I'd have to respectfully suggest that management get out there and get some hardcore marketing efforts going. When sales are down, you need to up the ante when it comes to branding and convincing patrons to come through your door. These comps are pretty weak and unattractive. Campbell's strong earnings growth topped expectations, while Krispy Kreme narrowed its loss, though it fell short of estimates.</p>
<p>This coming week should bring reports from more food-related companies, from cereal maker General Mills and food packager CongAgra to grocery chain Kroger, to the parent companies of restaurants Cracker Barrel, Olive Garden, Red Lobster, Carl's Jr., and Hardees. Also look for reports from tech-related companies such as Oracle, Adobe, and Palm, as well as from financials Morgan Stanley and Goldman Sachs, and from economic bellwether FedEx.</p>

<p>Beaverton, Ore.-based <a href="http://finance.aol.com/quotes/nike-inc/nke/nys">Nike Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/nike-inc/nke/nys">NKE</a>) said strong growth overseas helped boost its <a href="http://money.aol.com/news/articles/_a/nike-reports-12-percent-jump-in-q4-net/n20080625165009990016?cid=1183">fourth-quarter profit by 12%</a> to $490.5 million, or 98 cents per share. Analysts polled by Thomson Financial expected the company to earn 96 cents per share for the quarter. Shares fell more than 5% in after-hours trading to $62.15.<br /><br /><a href="http://finance.aol.com/quotes/cke-restaurants-inc-united-states/ckr/nys">CKE Restaurants Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/cke-restaurants-inc-united-states/ckr/nys">CKR</a>) said its <a href="http://money.aol.com/news/articles/_a/cke-restaurants-1q-profit-rises-8/n20080625171109990019?cid=1183">first-quarter profit climbed 8%</a> to $16.6 million, or 31 cents per share, helped by a small increase in same-store sales at Carl's Jr. restaurants. Revenue fell 3% to $466.2 million. Analysts polled by Thomson Financial expected profit of 27 cents per share on revenue of $465.5 million. Shares fell 5 cents to $12.25 in after-hours trading.</p>
<p><a href="http://finance.aol.com/quotes/red-hat-inc/rht/nys">Red Hat Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/red-hat-inc/rht/nys">RHT</a>) said its <a href="http://money.aol.com/news/articles/_a/red-hat-profit-climbs-almost-7-pct-in-1q/n20080625165109990080?cid=1183">fiscal first-quarter profit rose 6.6%</a> to $17.3 million, or 8 cents per share. Adjusted earnings were 18 cents per share. Revenue rose 32% to $156.6 million. Analysts polled by Thomson Financial on average predicted a profit of 18 cents per share on revenue of $153 million. Shares fell 19 cents in after-hours trading to $22.11.</p>
<p><a href="http://finance.aol.com/quotes/general-mills-inc-united-states/gis/nys">General Mills Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/general-mills-inc-united-states/gis/nys">GIS</a>) said its <a href="http://money.aol.com/news/articles/_a/general-mills-raises-cereal-prices-as/n20080625162809990026?cid=1183">fourth-quarter profit dropped 17%</a> to $185.2 million, or 53 cents per share. Adjusted earnings were 73 cents per share, which met Wall Street expectations. Sales increased 13% to $3.47 billion beating expectations. The company reaffirmed its guidance for the full year. The investor, Ramius LLC, has good reason to be asking for the cuts, too. It alleges that CKE continues blaming its performance on a downtrodden U.S. economy, when, in fact, it has not made the changes to ensure its cash flow has the means to grow.<br /><br />CKE's annual shareholder's meeting is today, and there will probably be several calls to figure out what the company's board is doing to ensure the best return for its constituents. Ramius said, "It is unacceptable for management and the board to stay the course and continue to blame the company's poor operating performance on economic issues out of its control." With <a href="http://www.marketwatch.com/news/story/cke-holder-ramius-calls-hardees/story.aspx?guid={88373DEB-6024-431B-A209-331873C96D9F}&amp;dist=msr_1">CKE's shares down 48%</a> from its 52-week high, and with the most recent quarter having seen a 38% net income drop, the pressure is on. <br /><br />Ramius went on to suggest that CKE <a href="http://www.marketwatch.com/news/story/cke-holder-ramius-calls-hardees/story.aspx?guid={88373DEB-6024-431B-A209-331873C96D9F}&amp;dist=msr_1">consolidate its three headquarters buildings</a> and figure out why the company's absolute G&amp;A figure hasn't really changed since 2001. "In light of the current economic outlook, the company's $145 million capital-spending plan for fiscal 2009 is too aggressive and unwarranted," said Ramius. The investor plans to vote its shares against CEO Andrew Puzder and three other board members today at the annual shareholder's meeting.<br /><br />I like examples of astute investors doing homework to make a case against an investment, and this qualifies. CKE responded by saying it welcomes a "more thorough dialogue" with Ramius. Total revenue decreased 3% for the quarter, and net income from continuing operations was $0.00 per diluted share, which wasn't too good in comparison to last year's number, which was $0.17 per diluted share. Total revenue was flat for the year, and net income from continuing operations was $0.57 per diluted share versus $0.77 per diluted share in the previous fiscal year.</p>
<p>CKE Restaurants, which operates the Carl's Jr. and Hardee's brands, did not impress analysts, as earnings expectations for the quarter were missed by two pennies. I myself wasn't too impressed with the entire report. Same-store sales increased 0.9% at Carl's Jr. and 2% at Hardee's for 2007 -- I'm not going to jump up and down over that bit of news. In addition, costs are up because of inflationary pressures, and revenues have obviously been challenged. There's not a lot that I like about this story.</p>
<p>CKE's stock is certainly on the lower end of its 52-week range, but I can't say it is necessarily cheap; it closed yesterday at $12.45 -- the high for the year on the stock is $23.24. This is a situation that calls for an old standby: "There are better opportunities out there in this space." For me personally, if I'm looking at the burger business, I'm way more likely to consider a <a href="http://finance.aol.com/quotes/mcdonald-s-corporation/mcd/nys">McDonald's</a> (NYSE: <a href="http://finance.aol.com/quotes/mcdonald-s-corporation/mcd/nys">MCD</a>), a <a href="http://finance.aol.com/quotes/burger-king-holdings-inc/bkc/nys">Burger King</a> (NYSE: <a href="http://finance.aol.com/quotes/burger-king-holdings-inc/bkc/nys">BKC</a>), or a <a href="http://finance.aol.com/quotes/wendy-s-international-inc/wen/nys">Wendy's</a> (NYSE: <a href="http://finance.aol.com/quotes/wendy-s-international-inc/wen/nys">WEN</a>) before I entertain CKE as an investment idea. Although they don't do burgers (so far as I know), I'd even look at a <a href="http://finance.aol.com/quotes/yum-brands-inc/yum/nys">Yum! Brands</a> (NYSE: <a href="http://finance.aol.com/quotes/yum-brands-inc/yum/nys">YUM</a>) before CKE. These companies have better brand equities in my estimation. CKE may turn itself around, but I just wasn't impressed by my look at its data. </p>

<p><a href="http://finance.aol.com/quotes/cke-restaurants-inc/ckr/nys">CKE Restaurants</a> (NYSE: <a href="http://finance.aol.com/quotes/cke-restaurants-inc/ckr/nys">CKR</a>), parent company of Hardee's and Carl Jr.'s is suing <a href="http://finance.aol.com/quotes/jack-in-the-box-inc/jbx/nys">Jack in the Box</a> (NYSE: <a href="http://finance.aol.com/quotes/jack-in-the-box-inc/jbx/nys?tabs=quotesandnews">JBX</a>) for a television commercial which allegedly suggests that the company's famous angus burgers are made from cow anus (see YouTube video above).</p>
<p>This is one of the more entertaining legal cases I've seen in awhile. <a href="http://money.aol.com/news/articles/_a/jack-in-the-box-ads-called-misleading/n20070525220609990018">According to the Associated Press</a>, "CKE claims the ads create the misleading impression that Jack In The Box's new 100 percent sirloin burgers use a better quality of meat than the Angus beef used by Carl's Jr. and Hardee's. CKE claims the spots confuse consumers by comparing sirloin, a cut of meat found on all cattle, with Angus, which is a breed of cattle."</p>
<p>According to CKE CEO Andrew F. Puzder "They're not being funny. They need to stop misleading people about what Angus beef is."</p>
<p>Here's the problem: They actually are being funny. And I certainly don't claim to be a legal expert, but I think that part of Jack in the Box's defense is going to be "Lighten up and learn to take a joke."</p>
<p>Puzder said that CKE had asked Jack in the Box to pull the ad, but the company refused, pointing to a Carl Jr.'s ad which suggested that its milkshakes were better than the competition. Here's the best part: Puzder said the comparison was not valid because they had not claimed that competitors made their milk from cow anuses. </p>
<p>This whole "scandal" seems like a tempest in a tea pot to me. Jack in the Box's commercial was a clever pun on the word "angus" and certainly not misleading. Did anyone watching it really come away thinking that angus burgers were made from anuses?</p>

Yes folks, Wendy's just isn't for lunch or dinner anymore (or dessert - mmmm Frosty's). You can now eat Wendy's for every meal of the day. By the end 2007, Wendy's expects to have 20-30% of its North American restaurants serve breakfast along with premium Folgers coffee.</p>

Wendy's is definitely throwing its hat into a very crowded ring. When looking at the coffee aspect, one has to recall last year's <a href="http://www.canada.com/reginaleaderpost/news/canada_world/story.html?id=9af404dd-0e49-4fee-bc57-01be823174ff"><em>Canadian Business</em> magazine taste test</a> between McDonald's "Caf&eacute; Roast" and Starbucks coffees. I'm sure all the companies I mentioned above serve some brand of coffee. Wendy's is really walking into a competitively caffeinated situation. We also can't forget about

's "<a href="http://sbux.bloggingstocks.com/2007/01/22/can-coffee-get-any-hotter-seattle-spins-sexpresso/">Sexpresso</a>" baristas, but that's competition on a different level.</p>

<p>McDonald's comes late to the Angus burger trend. Rivals <a href="http://finance.aol.com/quotes/burger-king-holdings-inc/bkc/nys">Burger King Holdings, Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/burger-king-holdings-inc/bkc/nys">BKC</a>), Hardees and Carl's Jr. -- the latter two part of <a href="http://finance.aol.com/quotes/cke-restaurants-inc/ckr/nys">CKE Restaurants, Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/cke-restaurants-inc/ckr/nys">CKR</a>) -- have been selling the premium burgers for years. In fact, Hardees has just announced a new addition to its menu, a patty melt style <a href="http://www.qsrweb.com/article.php?id=7621&amp;prc=66&amp;page=58">Thickburger</a>, also made with Angus beef.</p>
<p>The new burgers are part of McDonald's ongoing efforts at revitalization. Those efforts have included the introduction of new beverage choices, such as <a href="http://www.bloggingstocks.com/2007/05/01/mcdonalds-pitches-iced-coffee-with-ballplayers/">iced coffee</a>, which is also expected to spread throughout the U.S. soon. Another part of that effort is a new advertising campaign, emphasizing career opportunities at McDonald's -- no doubt to try to change its image as a source of low-paying, dead-end jobs. </p>
<p>The revitalization appears to be working. Back in April, McDonald's reported a strong quarter, <a href="http://www.bloggingstocks.com/2007/04/20/mcdonalds-still-serving-billions-at-home-and-abroad/">especially internationally</a>. So forget that quarter pounder -- the new burger will be a third-pounder as it finds its way into more McDonald's locations after being available now only in 600 locations in California. The burger is the most expensive single sandwich on the McDonald's menu at $3.99.<br /><br />With competitors now offering "premium burgers" that pack in as many calories as some complete meals, a McDonald's franchise owner told corporate headquarters a few years ago that a premium burger was needed so that McDonald's could remain competitive in the market (for huge burgers, I suppose). With CKE Restaurants' (NYSE: CKR) Carl's Jr. having all kinds of premium burgers on its menu (Restaurant Style, it calls them), I guess it was about time for McDonald's to respond. But while it's new $3.99 will be its most expensive, there are still some burgers at Carl's Jr. that retail for about $6.
