U.S. Stock Futures Up as Investors Await Manufacturing, Construction Data
U.S. stock futures are higher Tuesday morning as investors await economic data. Futures for the Dow Jones Industrial Average surged 49 points to 12,263.00, while those for the S&P 500 index gained 6.10 points to 1,332.20. Futures for the Nasdaq 100 index climbed 14.25 points to 2,365.00.The U.S. stock market closed higher on Monday, driven by an upbeat personal income report. The Dow Industrials gained 0.79% and the S&P 500 rose 0.56%.
U.S. ISM manufacturing data for February and construction spending data for January will be released at 10 a.m. ET. Auto sales data for February will also be released on Tuesday.

The day before Thanksgiving was a very positive as the caution of Tuesday faded. The skirmish in the Koreas was calmed a bit and jobless claims nearly came in under 400,000 for the prior week. Even the woes of Europe seem to be calming on Ireland's major austerity cuts even if Portugal and England had demonstrations out in the streets. October new home sales was a disappointing 8% drop but consumer confidence is holding up. Here are today's closing bell levels:

Will TiVo Pop or Drop After Its Q3 Report?
Television titan TiVo (TIVO) will step into the earnings spotlight after tonight's closing bell, with Wall Street looking for a third-quarter loss of 17 cents per share -- wider than TiVo's year-ago deficit of 6 cents per share. The firm has been on a hot streak with its quarterly reports, having exceeded analysts' consensus earnings expectations in each of the last three reporting periods.However, the equity's technical performance isn't quite so impressive. The shares took a dive earlier this month after TiVo's patent dispute with EchoStar (SATS) and Dish Network (DISH) took an ugly turn in the courtroom, and the stock has yet to recover.

Risk/Reward in TiVo Is Extremely Compelling
A fairly obvious trade is presenting itself in shares of TiVo (TIVO). The company has been involved in patent infringement litigation with DISH Network (DISH) and Echostar (SATS) since 2004. At pretty much every step of the way, TiVo's claims have been upheld, including by the U.S. Patent Office this last October.
Currently, the U.S. Court of Appeals for the Federal Circuit is conducting an en banc review of an earlier decision, which upheld a lower court's ruling in TiVo's favor with regard to the infringement of company patents by DISH and Echostar. The CEO of TiVo has said that he expects the litigation to be resolved by February or March of 2011.

Does TiVo Have What It Takes to Survive After Another Quarterly Loss?
TiVo Inc. (TVO) has been desperately trying to find as many strategies as possible to ensure it stays the household name among the Digital Video Recorder (DVR) market. From a marketing perspective, the term "DVR" trumping the term "tivo" could signal the television recording pioneer's downfall. Based on its latest quarterly numbers, it may already be happening.
For the fifth time in a row, TiVo recorded a quarterly loss. This after just announcing the TiVo Premiere product that intends to integrate television/cable/satellite with web-based video content and give the customer a single interface for all their video. Problem #1: it's $300 -- quite a wallop. Problem #2: the competition is heating up fast. What does TiVo intend to do about it? If it can't make money on its hardware and subscribers are being lost to competing DVR services on cable and satellite networks, there's darkness on the horizon.

TiVo Records Another Loss in Q1
TiVo (TIVO), an expert in digital-video recording, closed Tuesday's regular session at $9.15. It was up over 1%. Sure, that sounds swell when juxtaposed with Tuesday's market action. It does nothing, however, to make me like the stock.
The 52-week low for the shares is $6.41. The 52-week high is $18.93. The one-year chart is ... not appealing. You've got a big spike in buying interest near the right side, preceded by sideways action. Then, a nasty plunge. How can you possibly comprehend this technical situation? It's difficult at best, and I'm not going to pretend I know where the stock is heading.

- JMP Securities upgraded Boston Properties (BXP) to outperform from market perform and has an $89 price target on the stock. - Baird upgraded Bucyrus (BUCY) to outperform from neutral, citing valuation and an a more favorable view of the Terex Mining acquisition. The firm has an $83 price target on the stock.

The day started out in the red, and just sold more into the red from there. The only good news is that stocks did close well off their lows as some investors decided to bargain hunt late in the afternoon ahead of the close, in case a new rescue or aid package is released (or re-released). Gold even came off of new record highs after this morning. Here were the unofficial closing bell levels:

DISH Network: Buy or Sell?
DISH Network Corp. (DISH), a provider of television entertainment channels whose competitors include Comcast Corporation (CMCSA) and DIRECTV (DTV), is trading higher about an hour before the closing bell. It's up 50 cents, or over 2%, to $21.80. Volume isn't that great, though. And I have to say, I'm not sure I'd want to join in with the buyers.
Over the last twelve months, the stock has seen a nice rise. Before you become too impressed, keep in mind that the 52-week range is a relatively narrow one. The low is $14.17, while the high is $23.06.
Closing Bell: Across the Board Wins for the Markets (SPG, GGP, NBG, BPAX, TIVO, SIRI, GS)
If you looked at the overseas trading markets versus the US this morning, this was one of those days that could have gone either way. This followed a financial rescue package for Greece, and also followed the biggest gain in US manufacturing in almost six years, that even with a rise in construction spending.
